Passing the A.B.C. Test

The A.B.C. test is the primary test to determine whether a worker is properly classified as an independent contractor. It is a three part test and all three questions of the A.B.C. test must be answered with a “yes” for a worker to be considered an independent contractor. The 1st question is below:

A.When performing the work, is the worker free from your company’s control and direction?

  • “Control” and “direction” relate to the level of how much of a say the worker has in performing the work. Your company can provide broad guidelines and work deadlines but a worker must have the freedom to decide how the work will be done and how the deadlines will be met.
  • A baseline to use in answering this question is to assess whether your company is treating the worker in the same manner as it would treat an employee.
