2. Is the worker’s performance free from the control and direction of your Company?
“Control” and “direction” relate to the level of how much of a say the worker has in performing the work. Your company can provide broad guidelines and work deadlines but a worker must have the freedom to decide how the work will be done and how the deadlines will be met.
A baseline to use in answering this question is to assess whether your company is treating the worker in the same manner as it would treat an employee.
